A Patient with diagnosis of cholelithiasis was undergone lap choley and two metal clips were used. The patient remained stable for six years. Then, he had severe abdominal pain and jaundice which was due to migration of metallic clips and causing obstructive jaundice.
Consumer court found it to be due to fault of first surgeon which is nothing else than medical negligence and directed to doctor and hospital to pay a compensation of 8 lacs. What is your opinion, Is it really medical negligence and how to avoid such incidents in future?
