I would like to ask two questions for our fraternity. Firstly, I would like to know some of realities of the SC verdict by two judges bench (including Mr Markende Katju CJI) in 2009 on medical negligence, where he said no negligence verdict should be pronounced (as long as it is not a prima facie case ) by any court without an expert (in particular field of medicine) opinion sought and the doctor concerns shall not be arrested or harassed by any authorities including police, also order an arrest warrant against police officer who violates such order henceforth. Now what are the routes left to the victimised doctors who cry fouls for flouting the verdicts by local DC/consumer court/police ?
