The Bombay High Court has quashed an order that removed two doctors from the medical register for six months and three years , respectively, in a case involving treatment for chronic urinary obstruction and recurrent urethral stricture. The Court found serious procedural irregularities in the disciplinary proceedings and held that a doctor's selection of one recognized treatment approach over another cannot, by itself, amount to medical negligence. The patient had a longstanding problem involving narrowing of the urinary tract and persistent difficulty in urination. One doctor treated him in 2005 for a ureteric stone and urinary obstruction.
