The case A patient was diagnosed with urinary bladder cancer and was required to be operated on immediately. The doctor allegedly left one scissor (size 7–10 inches) inside his abdomen during the operation and the patient started having acute pain in his abdomen. A case was filed against the treating doctor (Dr. A), another doctor (Dr. B) who was working as an employee of Dr. A, and the hospital.

The scissor had to be recovered from the patient’s abdomen and he was put under treatment, which cost him ₹15 lakh. The petitioner’s plea The doctor failed to perform his duties efficiently and carefully with due diligence. The highly negligent behavior of the doctor led to physical and mental agony for the patient and his family.
