Of late, we keep hearing about so-called lawsuits against doctors for alleged negligence. Though, it needs to be proved beyond doubt in the honorable court that actually the negligence did take place. I presume that for purpose of differentiation between Error of Judgment and Negligence a Board of Experts (Doctors) is detailed by State medical Council or CMO of the District. It is a separate matter that these days even CMOs are blamed by DMs for so called medical negligence since MOs are found absent from duty. Many of us many times do not understand what exactly constitutes medical negligence! I am trying to innumerable the alleged circumstances/incidents which might constitute negligence in the eyes of law.
