Owner of Hospitals and organizations are vicariously liable for acts of their employees (including Doctors). If a Doctor is treating a patient in course of his employement and served with  a notice from Court or Consumer forum seeking damages then the Doctor should reply to the notice giving following points:- 1. Complainant was under treament of hospital owned by organization and hence the notice should be directed to hospital authority. 2. The patient was never treated in private capacity by Doctor but he recived treatment from hospital.

Hence Hospital authoirities/owner be made respondent and not Doctor. Once this is done The hospital will be compelled to defend the case, bear legal expenses and pay damages if required.
