A surgeon should owe a duty of care to his/her patients. Postoperative complications following a surgery often as a result of the surgical errors. In such a scenario, the surgeon should take the responsibility of care to his patients at least to the time the patient being hospitalized. Now, suppose a surgeon planned a leave to abroad or some distant location after a surgery or during the post-surgery period. The patient who is operated by this surgeon is hospitalized and now feeling some unusual complications.
In this case, can a surgeon appoint another surgeon to look after the patient? If yes, suppose the patient come up with some serious traumatic condition for which the reason can’t be defined, who is responsible? What are your suggestions to appoint a substitute or on-call physicians avoiding such cases? Will there be any legal implications to the hospital administration?
