A 25-year-old female patient presented with intestinal obstruction to a general surgeon. Ultrasound abdomen showed Ileo-ileal intussusception. She was operated on immediately and resection of ileal segment with end to end anastomosis was done with corrugated drain. Postoperatively on day 6, she developed anatomist leak and was referred to us. She was taken to surgery immediately. Intraoperatively the corrugated drain was found inside the abdomen and it was removed.
Resection of the anastomotic leak site was done with an ileostomy. Day 4 post-op, the patient developed Septicaemia with ARDS. She was put on a ventilator. She didn't maintain saturation throughout and on day 6 she succumbed. What are the medico-legal consequences of this case?
