The national commission has now recommended that hospitals are liable to pay if consulting doctors involved in case of medical negligence. This decision comes after the death of a 24-year-old patient’s petition who filed a negligence case. The said patient was under the care of an orthopedic surgeon after a fall seven years ago. On October 9, 2003, the surgeon performed a spinal surgery and she was discharged 10 days later.

Post-surgery, the patient developed severe complications and was taken to the hospital for severe fits. The orthopedic surgeon referred her to a psychiatrist who in turn referred her to a neurosurgeon who advised her to be hospitalized at some other Medical Centre. Later, she was advised to go back to the orthopedic surgeon for the restoration of bowel movements caused due to the first surgery.
