The national commission has now recommended that hospitals are liable to pay if consulting doctors involved in case of medical negligence. This decision comes after the death of a 24-year-old patient’s petition who filed a negligence case. The said patient was under the care of an orthopedic surgeon after a fall seven years ago. On October 9, 2003, the surgeon performed a spinal surgery and she was discharged 10 days later.
Post-surgery, the patient developed severe complications and was taken to the hospital for severe fits. The orthopedic surgeon referred her to a psychiatrist who in turn referred her to a neurosurgeon who advised her to be hospitalized at some other Medical Centre.
