The National Consumer Disputes Redressal Commission (NCDRC) set aside an order of the State Consumer Disputes Redressal Commission (SCDRC) that had held Sanjay Gandhi Postgraduate Institute of Medical Sciences (SGPGI), Lucknow, and four of its doctors guilty of medical negligence in the treatment of a child with blood cancer. The State Commission had awarded a total compensation of Rs. 44 lakh (Rs. 30 lakh for mental agony and torture and Rs. 14 lakh as compensation) to the patient’s family.

On appeal, the NCDRC exonerated the doctors and the hospital from negligence in treatment but held the institute liable for deficiencies in medical record disclosure, awarding Rs. 5 lakh as compensatory damages and Rs. 1 lakh as litigation costs.
