Strange things are happening in this country. I am addressing this question to DR M.C.gupta a legal expert and to other experts on this forum The reference to my question is - Today's news_ CMO"( Cheif Medical Officer and treating doctor suspended for botched up Cataract surgery cases. The reason ( preliminary one) is - Poor sterilization of equipment. Is there no accountability of paramedics and OT staff who are supposed to perform this function? Does the whole responsibility is of Doctor only. I had heard about the vicarious liability.
But in some many other cases - Like manhole left open - and a child dies. I have not heard the MCD chief being suspended. Riots occur and DG police not suspended. Something goes wrong done by a Sr resident who is fully qualified and consultant is being directly held responsible for negligence? Kindly elaborate
