According to the Surrogacy (Regulation) Bill, 2016 that was passed earlier this year, commercial surrogacy has been prohibited in India. Infertile couples who have been married for 5 years or more and have a close relative to be a surrogate mother can, however, go ahead with surrogacy provided it is on a purely altruistic basis.
The bill also proposes the establishment of a National Surrogacy Board both at the central and state level to regulate the process of surrogacy. This decision had led to a lot a debate regarding the pros and cons of banning commercial surrogacy.
