The National Consumer Disputes Redressal Commission (NCDRC) has ruled out a medical negligence claim filed by a patient with a persistent sinus condition who underwent surgery and later developed post-operative complications. The Patient and the Treatment A patient from Bihar with chronic maxillary sinusitis sought help from an ENT specialist at a private hospital. After several investigations, the specialist recommended sinus surgery, which was performed in late 2008.

Following the procedure, the patient developed swelling and limited movement of the left eye. His condition did not improve locally, and he was referred to Lucknow for further care, where imaging showed bony defects in the sinus walls, air pockets near the orbit, and soft tissue inflammation.
