A woman with back pain due to L1 fracture reported neurosurgeon who advised operation. Patient deposited Rs 90,000/ with the hospital. During operation, attendants were told that patient needs the operation with advanced technology for which they have to pay Rs 60,000/ more and it was not affordable by patient hence they refused. Patient after some time of discharge again complaint of pain and consultant reassure that pain will be relieved after some time.Consultation with the second surgeon revealed that operation was not done in the proper way and her pain will go on aggravating.
The complaint was filed in consumer forum, medical negligence was proved and the doctor was asked to refund hospital bill plus Rs 50,000/- for mental harassment and Rs 10,000/ litigation charges. What Is your opinion about this case? Kindly share.
