A patient admitted to hospital as a case of acute cholecystitis. Conservative treatment was given. Probable Date of surgery was given to the patient after 3 months as per routine waiting list for surgery in hospital.

But patient did not come on the due date and after 5 months, the patient develops GB cancer & died. Is senior resident working in the department is responsible for medical negligence for the delay in definite treatment i.e. surgery?
