After Cataract surgery, the patient has normal vision and no complaint about 2 days. After that patient developed severe pain and infection in the operated eye resulting in loss of vision. In consumer forum, complaint of negligence was filed against operating doctor and attending the doctor. Operating doctor presented with the statement before the forum that he is visiting the surgeon in two or three hospitals of nearby with conditions that he will not be responsible for pre and post-operative care which is provided by attending doctor who is a doctor of that hospital.
Patient after developing pain reported to attending doctor first who provided required treatment. The court exonerated operating doctor but attending doctor was held guilty for negligence.
