One of my Psychiatrist friend is treating a 16 year-old-boy for last 3 months. My friend is unwilling to disclose the condition or problem, even to the parent of the child, for which the child is visiting him. This is mostly because the boy himself does not want my friend to disclose the issue and my friend also believes that this disclosure may hamper the treatment. But the problem started when the father of the boy came to my friend’s clinic and threatened her to sue and harass if she does not disclose him the reason of treatment of his son. My question is Can his father create a legal problem to my psychiatrist friend?
To my knowledge Indian majority act, 1875 clearly states the age for adulthood in India is 18. On contrary, IPC 88 and 90 states a boy over 12 years is capable of giving consent for his treatment. Which law or guideline will be followed in this case? What…
