Nowadays, doctors are being jailed for murdering patients but doctors are at a big disadvantage as compared to criminals in such cases more so over after passage of WB CEA which CM suggested as a model law to be adapted all over the Country. A criminal murderer can defend himself by: 1. Making the tools of murder disappear he had no MEANS. 2. Lawyer Finding Lacunae with the theory about MOTIVE. 3.
Finding fault with OPPORTUNITY by creating a movie like scenes, proofs of being not there etc. In the case of doctors all this goes against them: 1.They had the equipment and branded medicines for murder as MEANS. 2. Doctors are presumed BORN MURDERERS (having KILLER INSTINCT) being the MOTIVE. 3.Medical records and case sheets being Solid proofs of OPPORTUNITY, the doctor got to murder CANNOT BE DENIED. Kindly comment on this relative disadvantage doctors face as murderers in a court of law.
