A recent Madras High court order hands power to the police and government to prosecute quack doctors. This is post interim order in 2006 restraining authorities from penal provision enforcement against non qualified medical practitioners of the Indian Medical Council Act and the Drugs and Cosmetics Act. Prior to 2006, the police had prosecution authority; however, the Private Medical Practitioners Association (PMPA) filed a plea with the court seeking exceptions if practical experience in modern medicine existed.

This matter has now come for hearing after 10 years. The court stated ‘persons claiming to have practical experience in modern scientific system of medicine ganged up to form an association and have filed this petition.
