The provisions of termination of pregnancy in the Indian Penal Code were enacted about a century ago providing that abortion was a crime for which the mother as well as the abortionist can be punished, only except where it had to be done in order to save the life of the women. A breach of this strict law was observed in all over the country, as the prevailing circumstances and medical facilities were not found to be adequate. In order to save a pregnant woman, the Medical Termination of Pregnancy Act, 1971 was formulated.

Keeping in view the serious violation of the existing law i.e. Medical Termination of Pregnancy Act, 1971 and the Indian Penal Code, as noticed by this court, it is desirable that efforts are made to increase the overall awareness of the existing abortion laws and policies of the government so as to come down heavily on the doctors running these abortion clinics in…
