The charge of medical negligence has been made frequently against doctors by patients and their attendants. Inquiry committee set up to probe the complaint also mentions the word "negligence", how does it decide punishment? Negligence is of two types: Simple (civil liability) need to compensate Gross Negligence (criminal liability) punished under section 304A of IPC. My opinion is Medical Board must mention intensity of negligence in their report rather than leaving it to police or lawyer to decide.
