Surrogacy (Regulations) Bill 2016 (Bill No. 257 of 2016) proposes for domestic altruistic surrogacy and prohibits commercial, overseas or foreign and single parent surrogacy in India. The bill permits surrogacy only for "Indian heterosexually married couples whose marriage has subsisted for five years or more and either of the partners is infertile". On the other hand, Surrogacy 2005 did not object single parent surrogacy.

However, a couple of recent cases of celeb single parent surrogacy has given rise to a new debate on the permissibility of this bill in India. The Supreme Court acknowledges that "for certain individuals under typical medical situation"  and when surrogacy is the only option available to have a child that is biologically related to them.
