A long-running medical negligence dispute over Total Knee Replacement (TKR) surgery has ended with the National Consumer Disputes Redressal Commission (NCDRC) upholding relief for a private hospital in Gurugram and its orthopedic surgeon. The Commission found that the patientβs post-surgical complications, though unfortunate and prolonged, did not by themselves establish negligence. It held that known risks such as infection, especially in a patient with rheumatoid arthritis, cannot automatically be treated as proof of deficient care.
The patient, a doctor, had been living with arthritis for several years and developed significant knee problems in 2010.
