The clause 1.5 of code of medical ethics, 2002 says “Every physician should, as far as possible, prescribe drugs with generic names and he / she shall ensure that there is a rational prescription and use of drugs.” This clause was modified by the Gazette notification of the Govt of India on 31/09/2016 as follows “Every physician should prescribe drugs with generic names legibly and preferably in capital letters and he/she should ensure that there is a rational prescription and use of drugs”. Unfortunately in the last seven months no doctor has faced any disciplinary action for not prescribing in generic names by the MCI.
It is also possible that there is no complaint against any doctor for not prescribing the generic drugs but it is worth mentioning here that the MCI has got the power to take suo moto action against any registered medical practitioner under code of medical ethics.…
